GutLens collects biometric information through a 30-second live video face scan. This includes: facial geometry measurements, iris patterns and fiber density, scleral vascularity data, skin perfusion measurements, and periorbital signals. Under the Illinois Biometric Information Privacy Act (BIPA) and applicable state and international laws, this data is classified as sensitive biometric information requiring heightened protection.

In compliance with Illinois BIPA and applicable state biometric laws, GutLens maintains the following retention and destruction schedule:

Before collecting any biometric data, GutLens: (a) informs you in writing of the specific biometric data being collected; (b) states the purpose and length of time for which the data will be collected, stored, and used; (c) obtains your explicit written consent via a separate biometric consent popup before any scan begins. You may withdraw consent at any time by choosing the photo upload option instead.

GutLens does not sell, lease, trade, or otherwise profit from your biometric information or biometric identifiers. Your biometric data is used solely to generate your personalised gut health protocol and for no commercial purpose beyond this.

GutLens does not disclose, redisclose, or disseminate your biometric information to any third party except Anthropic (solely for real-time analysis processing), unless required by law or court order. We do not share biometric data with advertisers, data brokers, or any commercial third parties.

GutLens stores, transmits, and protects biometric data using a reasonable standard of care consistent with how we protect other confidential and sensitive information. All biometric data is transmitted via HTTPS encryption. No biometric data is stored in any database or persistent storage system.

Illinois (BIPA): You have the right to sue GutLens for violations. Statutory damages: $1,000 per negligent violation, $5,000 per intentional violation, plus attorney fees.

Texas (CUBI): You have the right to know what biometric data is collected and to request deletion.

Washington (My Health MY Data Act): You have the right to access, correct, and delete your biometric health data. You may withdraw consent at any time.

California (CCPA): You have the right to know, delete, and opt-out of sale of your biometric data. We do not sell biometric data. See "Your Privacy Choices" for additional California rights.

In the event of a security breach involving your biometric or health data, GutLens will notify affected individuals and the Federal Trade Commission within 60 days of discovery, as required by the FTC Health Breach Notification Rule (16 C.F.R. § 318). Notification will be sent to the email address provided, if any, or posted prominently within the app.

To exercise any biometric privacy rights, request deletion, withdraw consent, or inquire about our biometric data practices: Email privacy@hivibe.world with subject line "Biometric Privacy Request" and your state of residence. We will respond within 30 days (10 business days for Illinois BIPA requests).

This Biometric Data Policy is publicly available at all times within the GutLens app. We will provide 30 days notice of any material changes. Continued use of the biometric scan feature after notice constitutes acceptance of updated terms.

If you are a California resident you have the right to: (a) Know what personal information we collect, use, disclose, and share; (b) Delete personal information we have collected about you; (c) Correct inaccurate personal information; (d) Opt-out of the sale or sharing of personal information (we do not sell or share); (e) Limit the use of sensitive personal information including biometric data; (f) Non-discrimination for exercising your rights. To submit a CCPA request email privacy@hivibe.world with subject "CCPA Request." We respond within 45 days.

GutLens collects the following categories of sensitive personal information: Biometric data (facial scan, iris patterns, skin perfusion). We use this data solely to generate your gut health protocol. We do not use sensitive personal information for purposes other than those disclosed. You have the right to limit our use of your sensitive personal information by declining the biometric scan and using photo upload instead.

If you are an Illinois resident your biometric data is protected under the Illinois Biometric Information Privacy Act (740 ILCS 14). You have the right to: (a) Informed written notice before collection; (b) Written consent before collection; (c) Know our retention and destruction schedule; (d) Sue GutLens for violations without proving actual harm. If you are a Washington State resident you have the right to: (a) Confirm whether we collect your health data; (b) Access your health data; (c) Withdraw consent and request deletion; (d) Not be discriminated against for exercising your rights. If you are a Texas resident you have the right to know what biometric data is collected, the purpose of collection, and to request deletion upon fulfillment of that purpose. Contact privacy@hivibe.world with subject "Texas CUBI Request."

In the event of a breach of your health or biometric data, GutLens will notify you and the FTC within 60 days of discovery as required by the FTC Health Breach Notification Rule.
